Terms of Service

Welcome to Our Cabaret, LLC. These Terms of Service (“Terms”) govern your use of our services, including booking performances such as Nunsense and Our Cabaret Carolers. By engaging with us, you agree to these Terms.

 

1. Scope of Services

Our Cabaret, LLC offers two primary services:

  • Nunsense performances, produced under special arrangement with Concord Theatricals, New York, NY.

  • Our Cabaret Carolers for private and corporate events during the holiday season.

All bookings are made via direct communication with our general manager. A contract must be signed to finalize any booking.

 

2. Cancellation and Refund Policy

Nunsense:

  • A 20% non-refundable deposit is required upon signing the contract.

  • The full balance must be paid 30 days prior to opening night.

  • Refund eligibility for cancellations depends on the timing of the cancellation.

Our Cabaret Carolers:

  • No deposit is required.

  • Full payment is due by the day of the event.

  • Refunds for cancellations may be granted at our discretion, depending on how close to the event the cancellation occurs.

 

3. Payment Terms

  • Payments can be made via Wave, Venmo, PayPal, or by cash/check.

  • Nunsense requires a 20% non-refundable deposit, with the remaining balance due 30 days before opening night.

  • For the carolers, payment must be made by the day of the event.

 

4. User Conduct

We expect clients to communicate respectfully during booking and event interactions to ensure smooth operations and positive experiences.

 

5. Dispute Resolution

All disputes shall be resolved through arbitration.

  • The client is responsible for the legal fees of both parties involved in the dispute.

  • These Terms and all transactions are governed by the laws of the Commonwealth of Pennsylvania.

 

6. Intellectual Property

Nunsense is written by Dan Goggin and produced through special arrangement with Concord Theatricals, New York, NY.

 

Our Cabaret, LLC owns the following intellectual property:

  • The name “Our Cabaret Productions”

  • The name “Our Cabaret Carolers”

  • All company logos and publicity photos/videos

  • All content on our website

  • The trademark “For the good times”

 

Users may share promotional videos and materials with proper credit to Our Cabaret, LLC.

 

7. Service Modifications

We reserve the right to modify or cancel performances and events due to unforeseen circumstances (e.g., inclement weather or emergencies).

 

8. Limitation of Liability

Our Cabaret, LLC is not liable for damages or losses resulting from cancellations or delays beyond our control. In such cases, efforts will be made to reschedule the event or refund eligible payments.

 

9. Subcontractors

Performers, photographers, videographers, technicians, production assistants, and others engaged for events or performances are independent subcontractors of Our Cabaret, LLC.

  • Subcontractors are legal adults (18 years or older).

  • They are not employees of Our Cabaret, LLC, and the company is not responsible for their personal conduct beyond the scope of the contracted service.

  • Any agreements regarding subcontractors’ services or deliverables (e.g., photography or videography) may be subject to separate arrangements between the client and the subcontractor, if applicable.

 

10. Updates to These Terms

We may update these Terms periodically to reflect changes in our services or legal requirements. The latest version will always be posted on our website with the effective date.
